Terms of Service

These Terms of Service are an agreement between you and Melovibx ([registered company name], a company registered in Ghana, [registered address]) ("Melovibx", "we", "us"). They apply when you use the Melovibx app, the melovibx.com website, and the services we provide through them. By creating an account or using Melovibx, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Melovibx.

1. Who can use Melovibx

You must be at least 18 years old, or the age of majority where you live, to create an account. [Owner and lawyer to confirm the minimum age.]

You must give accurate information when you sign up, keep it up to date, and verify your email address and phone number.

You are responsible for your account and everything done with it. Keep your password private and tell us at once if you think someone else has used your account.

2. Buyers and artists

When you join you choose to be a buyer or an artist. Buyers discover, follow, rate, collect, and buy artworks, downloads, and prints, and can order prints of their own images. Artists publish artworks, stories, bundles, and short videos (Sweeps), and earn from sales. Some features are only for one role.

3. Content you publish

You keep ownership of the artworks, photos, videos, text, and other content you publish or send on Melovibx ("Content").

By publishing Content, you grant Melovibx a worldwide, non-exclusive, royalty-free licence to host, store, copy, resize, convert, display, and promote it on Melovibx and in Melovibx marketing, and, for artworks offered for printing, to print it on the products buyers order. The licence lasts while the Content is published, and afterwards only for orders placed before it was removed and for copies we must keep by law.

You confirm that you own the Content or have every right needed to publish and sell it, and that it does not infringe anyone else's rights (including copyright, trademark, privacy, and publicity rights).

Artists choose, for each artwork, whether it can be bought as a print, as a download, or both. Stories are shown for 24 hours and then stop being shown.

Melovibx may remove Content or suspend accounts that break these Terms or the law, or that are reported and found to infringe someone's rights.

4. Buying downloads and prints

Prices for artworks, downloads, bundles, and prints are set and charged in Ghana cedis (GHS). The app may also show an approximate amount in US dollars as a guide; you are always charged the GHS amount. Taxes and delivery charges are shown before you pay. Melocoin packages are priced by the App Store or Google Play: see section 7.

In the iPhone and Android apps, downloads and bundles are paid with Melocoins. The app shows the price in Melocoins, worked out from the GHS price, before you pay, and takes them from your balance when you confirm. Prints are paid in GHS as above.

Payments are processed by Paystack. Melovibx does not see or store your full card details.

A download gives you a personal, non-exclusive, non-transferable licence to keep and view the file for your own private, non-commercial use. It does not give you copyright in the artwork, and you may not resell, share, or reproduce it.

Melovibx prints and ships every print order. Delivery times are estimates. Colours and textures on a printed product may differ slightly from how they look on your screen. Tell us within [7] days of delivery if a print arrives damaged or wrong.

Custom prints of your own images: you confirm that you own the image or have the right to have it printed, and that it is lawful. Low resolution images may print less sharply, and the app warns you when it detects one. Our staff look at every custom print before it is printed, and we refuse (and refund) an image that appears to use someone else's work without permission, or that is unlawful.

5. Cancellations and refunds

A print can be cancelled before it goes into production. When Melovibx cancels a print or cannot fulfil it, we refund what you paid for it, including its share of tax, to your original payment method.

Downloads are delivered at once, so they are not refundable once the file is available, except where the law requires otherwise.

6. Artist earnings and payouts

Artists earn a share of each paid sale, at the rates shown in the app. Melovibx may change these rates for future sales with notice.

Earnings become available for payout once a sale is final, after a holding period shown in the app. Payouts are paid in Ghana cedis to the payout account the artist adds.

A newly added payout account can be used only after a waiting period, and payouts are checked by Melovibx staff before they are sent, to protect artists from fraud.

Earnings from a sale that is refunded, reversed, or found to be fraudulent may be withheld or deducted.

Artists are responsible for any tax due on their earnings.

7. Melocoins, boosts, tips, and subscriptions

Melocoins are Melovibx's own coins. You buy them in the app and use them inside Melovibx to buy downloads and bundles, to boost your content, and to tip artists.

Buying Melocoins: Melocoins are sold in packages. You buy them in the iPhone and Android apps through Apple's or Google's own purchase system, at the price the store shows in your currency. Melocoins are added to your balance once your payment is confirmed. We may not offer Melocoins for sale at all times or in every country.

What Melocoins are not: Melocoins are not money. They have no cash value, earn no interest, cannot be exchanged for cash or withdrawn, and cannot be sold or passed to another person except as a tip in the app. They are a licence to use features of Melovibx, which you may use only on Melovibx.

Refunds: Melocoins are added at once, so a purchase of Melocoins is not refundable once they are in your balance, except where the law requires otherwise or where we charged you by mistake. [Lawyer to confirm.]

Boosts: an artist can spend Melocoins to have one of their own artworks, stories, bundles, or their profile shown more, for the number of days and at the reach level they choose. The cost in Melocoins is shown before the boost starts. A boost makes content rank higher and reach more people; it does not guarantee any number of views, followers, or sales. Boosted content is marked "Boosted" so people can tell it is paid placement.

A boost starts at once and cannot be stopped early or refunded by the artist. One boost runs on an item at a time. Boosted content must follow these Terms like any other content. If boosted content is removed for breaking these Terms, or the artist deletes it, the boost ends and its Melocoins are not returned. If we stop a boost by our own mistake, we return the Melocoins for the full days that were not used.

Tips: you can give Melocoins to an artist on one of their Sweeps, with an optional comment. All of the Melocoins you give go to the artist. A tip is a gift: it is final, it is not payment for any product or service, and it cannot be taken back. The artist sees your name, the amount, and your comment, and comments must follow the rules in section 8. An artist can use Melocoins they receive on Melovibx in the same way as Melocoins they buy.

Refunds by Apple or Google: if the store refunds a Melocoin purchase, we take those Melocoins back from your balance. If you already spent them, we may take back what is left and limit Melocoin features on the account. [Lawyer to confirm.]

Fair use: do not use tips or boosts to mislead people, to manipulate rankings, to move money between accounts, or to get around payment for sales. We may reverse or remove Melocoins obtained by fraud, by a payment that is later reversed, or by our error, and we may limit or suspend these features on an account while we look into it.

Changes and closing: we may change the packages, prices, boost costs, and how Melocoins can be used, for future purchases and boosts, and we will show the new terms before you buy. Melocoins left in an account that you delete, or that we close for breaking these Terms, are lost and are not refunded. Subscriptions are not available yet. Before they are offered, we will add their terms here and ask you to accept the updated Terms.

8. Rules for everyone

Do not publish or send anything illegal, hateful, harassing, sexually explicit involving minors, violent, or that infringes someone else's rights.

Do not impersonate anyone, mislead buyers, manipulate ratings, likes, or followers, or try to pay or be paid outside Melovibx for sales made through it.

Do not try to break, overload, scrape, or get around the security of Melovibx, or use it to send spam.

You can report content or accounts in the app, and you can block people. We review reports and may remove content or suspend accounts.

9. Ratings

Buyers can rate artworks from 1 to 5 stars. Ratings must be honest and your own. We may remove ratings that look fake or abusive.

10. NFC tags, QR codes, and links

Melovibx may give an artist an NFC tag and QR code that open the artist's page. A tag only opens that page; it does not prove that a print or artwork is genuine.

Artists may link to their music and other pages on services such as Spotify, Apple Music, Audiomack, Boomplay, and YouTube. Those services are not run by Melovibx, and their own terms and privacy policies apply when you use them.

11. Melovibx's own rights

The Melovibx name, logo, app, and website, other than the Content users publish, belong to Melovibx. You may not copy or use them without our written permission. We may change, add, or remove features of Melovibx.

12. Ending your account

You can delete your account at any time in Settings. Deleting it is permanent: your profile and content are removed, and downloads you bought can no longer be accessed. Records we must keep by law, such as payment and order records, are kept as described in the Privacy Policy.

We may suspend or close an account that breaks these Terms or the law, and we will tell you why unless the law or safety prevents it.

13. Liability

Melovibx is provided as it is. We work to keep it available and secure, but we cannot promise it will always be uninterrupted or free of errors.

To the extent the law allows, Melovibx is not liable for indirect or consequential losses, and our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.

14. Changes to these Terms

We may update these Terms. When we do, we will show you the new version in the app and ask you to accept it before you continue, and publish it on melovibx.com. If you do not accept, you can delete your account.

15. Law and disputes

These Terms are governed by the laws of the Republic of Ghana. If a dispute arises, contact us first so we can try to resolve it. Otherwise, the courts of Ghana have jurisdiction. [Lawyer to confirm.]
